Some customers may set certain audit requirements e.g. which auditing companies / audit certificates they will accept. Please always check with your customer before booking an audit.


Types of audits

The Sedex system will accept any type of first party, second party and third party ethical audit:-

First party audit: An audit performed within an organisation by the organisation’s own auditing resource (internal audit). This will often highlight areas for improvement which can be corrected before the visit from an external auditor.

Second Party audit: Audits of contractors/suppliers undertaken by or on behalf of a purchasing organisation. These can be used to identify problems which can be worked on together.

Third party audit: Audits of organisations undertaken by an independent certification body or registrar or similar third party organisation. This is the most commonly used audit for most Sedex members and is widely accepted as more impartial.

All of the above audits can be useful. However, it is important to check your customer’s requirements before committing to a particular audit type.

Pilot Terms of Reference – May 2014 - DRAFT
The Pilot Audit
a. The pilot will be a full private employment agency audit as detailed in section 2.1 of the Guidance.

b. There will be 3 UK based pilot audits on Private Employment Agencies that provide labour to suppliers of retailers taking part in this AAG Workgroup.

c. The cost of each pilot will depend on the number of auditing days involved and will be subject to a specific quotation by the auditing company. Each auditing company has agreed to offer a discounted day rate for the pilot. The retailer members of the AAG workgroup have agreed to part fund the cost of the pilots. The remaining cost will be met by the Private Employment Agency.

d. Private Employment Agencies should submit their interest to take part in the pilots to any of the AAG Workgroup Members by 30th May 2014.

e. The AAG Workgroup Members will agree the Private Employment Agencies to be piloted by 13th June 2014.
f. The pilots will be conducted and reports issued to the AAG workgroup by end September 2014
.

2. Auditing Companies

a. The auditing companies that will undertake the pilot will comply with the terms in this Pilot Terms of Reference.



c. The auditing companies will ensure that auditors undertaking the pilot have the skills and competencies as detailed in section 1.6 of the Guidance.

d. Each audit company will:

i. Conduct the Pilot strictly in accordance with Version

2. Advising the AAG workgroup on whether in their view the Guidance should remain a SMETA supplement or become a stand-alone document

SA8000 is an international standard for improving working conditions. This standard is based on the principles of the international human rights norms as described in International Labor Organisation conventions, the United Nations Convention on the Rights of the Child and the Universal Declaration of Human Rights. SA 8000 is the first auditable social standard and is independent of government bodies and single interest groups.

SA 8000 certification
SA8000 measures the performance of organisations in eight key areas: child labour, forced labour, health and safety, freedom of association and collective bargaining, discrimination, disciplinary practices, working hours and remuneration.

The systems put in place to achieve this certification are an ongoing process and involves the participation of employees to ensure systemic change. The benefits of adopting SA8000 includes improved staff morale, reliable business partnerships, enhanced competitiveness, less staff turnover and better worker-manager communication.

Child Labor: No use or support of child labor; policies and written procedures for remediation of children found to be working in situation; provide adequate financial and other support to enable such children to attend school; and employment of young workers conditional.
Forced and Compulsory Labor: No use or support for forced or compulsory labor; no required 'deposits' - financial or otherwise; no withholding salary, benefits, property or documents to force personnel to continue work; personnel right to leave premises after workday; personnel free to terminate their employment; and no use nor support for human trafficking.

Health and Safety: Provide a safe and healthy workplace; prevent potential occupational accidents; appoint senior manager to ensure OSH; instruction on OSH for all personnel; system to detect, avoid, respond to risks; record all accidents; provide personal protection equipment and medical attention in event of work-related injury; remove, reduce risks to new and expectant mothers; hygiene- toilet, potable water, sanitary food storage; decent dormitories- clean, safe, meet basic needs; and worker right to remove from imminent danger.

Freedom of Association and Right to Collective Bargaining: Respect the right to form and join trade unions and bargain collectively. All personnel are free to: organize trade unions of their choice; and bargain collectively with their employer. A company shall: respect right to organize unions & bargain collectively; not interfere in workers’ organizations or collective bargaining; inform personnel of these rights & freedom from retaliation; where law restricts rights, allow workers freely elect representatives; ensure no discrimination against personnel engaged in worker organizations; and ensure representatives access to workers at the workplace.
Discrimination: No discrimination based on race, national or social origin, caste, birth, religion, disability, gender, sexual orientation, union membership, political opinions and age. No discrimination in hiring, remuneration, access to training, promotion, termination, and retirement. No interference with exercise of personnel tenets or practices; prohibition of threatening, abusive, exploitative, coercive behavior at workplace or company facilities; no pregnancy or virginity tests under any circumstances.

Disciplinary Practices: Treat all personnel with dignity and respect; zero tolerance of corporal punishment, mental or physical abuse of personnel; no harsh or inhumane treatment.
Working Hours: Compliance with laws & industry standards; normal workweek, not including overtime, shall not exceed 48 hours; 1 day off following every 6 consecutive work days, with some exceptions; overtime is voluntary, not regular, not more than 12 hours per week; required overtime only if negotiated in CBA.
Remuneration: Respect right of personnel to living wage; all workers paid at least legal minimum wage; wages sufficient to meet basic needs & provide discretionary income; deductions not for disciplinary purposes, with some exceptions; wages and benefits clearly communicated to workers; paid in convenient manner – cash or check form; overtime paid at premium rate; prohibited use of labor-only contracting, short-term contracts, false apprenticeship schemes to avoid legal obligations to personnel.

Platinum certification of wrap will be issued for 3 consecutive years certification with all WRAP principles and successfully cleared each audits with no corrective action. Gold :- Gold certification of wrap will be issued for 1 year with all wrap principles during the subsequent audit. One year wrap certification begins from the date of issue of the certification not for the date of subsequent audit. The “Gold” certificate is equal to the wrap compliance certificate.
Silver : - Silver certification of wrap will be issued for 6 months with the wrap principles but have non–compliance in training and policies that need to be addressed. Facilities means not have any “Red Flag” non compliance such as health and safety issue, environment issue and child labor, harassment and abuse of the employees. Facilities must signify the employees are paid the legal wages and overtime compensation.
